Privacy Policy

How SimpleBlock SRL collects, uses, and protects your personal data.

This Privacy Policy describes how SimpleBlock SRL ("we", "us") processes your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Belgian data protection law.

1. Data Controller

The data controller is SimpleBlock SRL, registered at the Banque Carrefour des Entreprises de Belgique under number BE 0799.341.465 (RPM Bruxelles).

2. Personal Data

"Personal Data" means any information that relates to an identified or identifiable natural person (rather than to a legal entity, such as a company), such as name, address and contact details.

You may, at your discretion, refuse to make Personal Data available to us. However, such a refusal may be an obstacle to the initiation or continuation of the business relationship between you and SimpleBlock SRL.

Where payments are processed through a third-party payment processor, we do not store full payment card details on our systems and only receive the information strictly necessary for invoicing and accounting purposes.

3. Purposes

We always process Personal Data for a specific purpose and only process the Personal Data which is relevant to achieve that purpose. In particular, we process Personal Data, within applicable legal limitations, for the following purposes:

  • Client onboarding;
  • Client relationship management;
  • service implementation and execution;
  • engaging in prospecting and business development;
  • other purposes such as in case of merger or acquisitions, when required by third parties, for research and statistical purposes.

4. Legal Basis

The legal basis for the processing of Personal Data will be one of the following:

  • necessary for taking steps to enter into or executing or for carrying out our obligations under the Agreement;
  • required to meet our legal or regulatory responsibilities;
  • in limited circumstances, and as may be requested from you from time to time, we have obtained prior consent (for instance where required by law) or processed with your explicit consent in the case of special categories of Personal Data.

5. Recipients

Personal Data shall only be shared with our directors, employees, officers, and experts such as but not limited to legal counsels, accountants and tax advisors when required and on a "need-to-know" basis.

In some instances, we also share Personal Data with our suppliers, who are contractually bound to confidentiality, such as IT hardware, software and outsourcing providers and storage providers and others. When we do so, we take steps to ensure suppliers meet data security standards, so that your Personal Data remains secure.

6. International Transfers

The Personal Data transferred to our suppliers is in some cases also processed in non-EEA countries. We transfer your Personal Data abroad only to countries which are considered to provide an adequate level of data protection, or in the absence of such legislation that guarantees adequate protection, based on appropriate safeguards (e.g. standard contractual clauses adopted by the European Commission). If and to the extent required by applicable law, we implement the necessary legal, operational and technical measures and/or enter into an agreement with you before such transfers. You acknowledge and understand the underlying risks of such transfer.

7. Retention

We shall only retain Personal Data for as long as necessary to fulfil the purpose for which it was collected or to comply with legal or regulatory requirements. As far as necessary, we will keep Personal Data for the duration of the Agreement subject to applicable legal and regulatory requirements.

8. Your Rights

You shall have a right to access and to obtain information regarding your Personal Data that we process. Should you believe that any information we are holding about you is incorrect or incomplete, you may also request the correction of your Personal Data. You shall also have the right to:

  • object to the processing of your Personal Data;
  • request the erasure of your Personal Data;
  • request restriction on the processing of your Personal Data;
  • request your Personal Data be transferred to you (known as the "data portability" right); and/or
  • withdraw your consent where we obtained your consent to process Personal Data (without this withdrawal affecting the lawfulness of any processing that took place prior to the withdrawal).

You also have the right to lodge a complaint with the Belgian Data Protection Authority (Autorité de protection des données / Gegevensbeschermingsautoriteit), www.dataprotectionauthority.be.

9. Personal Data of Third Parties

If you communicate to us Personal Data relating to third parties (such as beneficial owners, representatives, shareholders or contact persons), you acknowledge and undertake that:

  • any Personal Data relating to third parties you disclose to us has been obtained and processed, and is disclosed, in compliance with applicable law;
  • you shall not do or omit to do anything in effecting this disclosure or otherwise that would cause us to be in breach of any applicable law; and
  • the processing of such Personal Data as described in this clause shall not cause us to be in breach of any applicable law and, without limiting the foregoing, you shall provide, before the Personal Data is processed by us, all necessary information and notices to the individuals that are the subject of the processing of Personal Data. You will indemnify and hold us harmless for and against all direct and indirect damages resulting from your failure to inform such individuals.

10. Cookies

Our website uses cookies that are strictly necessary for its operation. Where we use non-essential cookies (such as analytical cookies), they will only be placed with your consent, which you can withdraw at any time via your browser settings.

11. Changes

We may update this Privacy Policy from time to time. The date of the latest revision is indicated at the top of this page.
